1. Acceptance of Terms

By accessing or using Vizedly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These Terms apply to all visitors, users, and customers.

2. Description of Service

Vizedly is a web-based AI infographic platform that uses artificial intelligence to extract structured data from Wikipedia articles and render them as interactive, exportable infographics across 13 layout types. Features and usage limits vary by subscription plan.

3. Accounts & Registration

• —You must provide a valid email address to create an account.
• —You are responsible for maintaining the confidentiality of your login credentials.
• —You may not share your account or create accounts on behalf of third parties without authorisation.
• —You must be at least 13 years old to use the Service (16 in certain EU jurisdictions).

4. Acceptable Use

• —You may not use the Service to generate content that is unlawful, defamatory, or infringes third-party intellectual property rights.
• —You may not attempt to scrape, reverse-engineer, or disrupt the Service or its underlying infrastructure.
• —You may not use the Service to generate spam or misleading content at scale.
• —Automated access (bots, scrapers) is prohibited without express written permission.
• —You may not resell or sublicense access to the Service without prior written consent.

5. Intellectual Property

The Vizedly application, UI, branding, and underlying technology are owned by Vizedly and protected by copyright and other applicable laws. You retain full ownership of the infographic content you create. By using the Service you grant us a limited, non-exclusive, royalty-free licence to process your content solely to deliver the Service to you.

6. Wikipedia & Third-Party Content

Wikipedia content is licensed under Creative Commons Attribution-ShareAlike (CC BY-SA 4.0). When exporting infographics derived from Wikipedia articles, you are responsible for complying with applicable licences. Vizedly is not affiliated with the Wikimedia Foundation.

7. Subscription & Payment

• —Paid plans are billed monthly or annually in advance via Stripe.
• —All fees are non-refundable except as provided in our 14-day money-back guarantee.
• —We reserve the right to change pricing with at least 30 days notice to active subscribers.
• —Failure to pay may result in downgrade, suspension, or termination of your account.

8. Refunds

We offer a 14-day money-back guarantee from the date of your first payment on any paid plan. To request a refund, email billing@vizedly.com within 14 days. Refunds are not available for subsequent billing cycles or annual plans after the 14-day window.

9. Indemnification

You agree to indemnify, defend, and hold harmless Vizedly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Vizedly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-extracted content will be accurate or complete. AI outputs should be reviewed before publication.

12. Force Majeure

Vizedly shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, internet outages, or third-party service failures.

13. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, with or without notice. You may delete your account at any time. Sections covering intellectual property, indemnification, liability, and dispute resolution survive termination.

14. Dispute Resolution

Before filing any formal legal action, you agree to first contact us at legal@vizedly.com to attempt informal resolution. If a dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English, with proceedings in Delaware.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Changes to Terms

We may revise these Terms at any time. We will provide at least 14 days notice of material changes via email to registered users. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
